POL Article 6 § 87 : Freedom of Information Law Requests
Response Process Pursuant to POL § 87 (FOIL)
The FOIL request is received at Division Headquarters and date stamped. In the initial review of the request it is determined if a response can be made within five (5) business days. If it cannot, the Division will send an acknowledgement of receipt and an estimated time frame to locate and examine the record(s) sought. If the request cannot be resolved within twenty (20) business days following the acknowledgement, the Division will again notify the requestor in writing giving the reason for the delay and an estimated completion date.
The response time is subject to the complexity of the request as well as the volume of requests and level of resources at the time of the request.
The Division will notify you of any legally applicable fees and will not forward copies of requested records until payment is received.
Pursuant to POL Article 6 § 87 and Article 4 § 66-a, the current fee schedule follows:
Checks or money orders are made payable to the Superintendent of State Police. Be advised that a criminal investigation will be conducted pursuant to New York State Penal Law § 190.05 if a check is returned due to insufficient funds or accounts closed.
Upon receipt of payment, the Division will prepare and forward a copy of the applicable record(s) directly to the requestor.
The Division will notify you of the earliest available appointment if you requested to inspect records. Inspections are scheduled on business days between the hours of 9:00 am and 5:00 pm at Division Headquarters:
